ORDINANCE NO. 120, SECOND SERIES AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE CITY OF DODGE CENTER TO INCLUDE CERTAIN UNPLATTED LAND NOT EXCEEDING 120 ACRES IN AREA ABUTTING UPON THE CITY LIMITS

ORDINANCE NO. 120, SECOND SERIES

AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF THE CITY OF DODGE CENTER TO INCLUDE CERTAIN UNPLATTED LAND

NOT EXCEEDING 120 ACRES IN AREA ABUTTING UPON THE CITY LIMITS

WHEREAS, a certain Petition dated November 8, 2011, has been submitted requesting annexation of the territory hereinafter described; and

WHEREAS, no objections to the annexation have been received from the town board or any other land owners whose boundaries abut upon the boundaries of the land to be annexed; and

WHEREAS, a hearing was duly held by the governing body of the City of Dodge Center, Minnesota, on the proposed annexation after at least 30 days mailed notice; and

WHEREAS, the land described in the Petition abuts upon the city limits at the west boundary thereof.

THE COUNCIL OF THE CITY OF DODGE CENTER, MINNESOTA, ORDAINS:

Section 1. The City Council hereby determines (1) that the territory described herein abuts upon city limits and is urban or suburban in character; and (2) that none of the territory is included within the limits of any city.

Section 2. The territory annexed. The corporate limits of the city are hereby extended to include the unplatted land described as follows, and the same is hereby annexed to and included within the City as effectually as if it has originally been a part hereof:

Tract 1

Beginning at a point located 607.3 feet South and along the North-South Section line from the West Quarter corner of Section Twenty-eight (28), Township One Hundred Seven (107) North, Range Seventeen (17) West; thence South along aforementioned section line 402.7 feet; thence deflect right at an angle of 118°02' for 745.5 feet; thence deflect left at an angle of 28°49' for a distance of 660.0 feet; thence deflect left at an angle of 91°07' for a distance of 950.4 feet; thence deflect left at an angle of 121°26' for a distance of 708.7 feet; thence deflect right at an angle of 68°34' for a distance of 801.7 feet; thence deflect right at an angle of 54°08' for a distance of 845.8 feet; thence deflect left at an angle of 90°00' for a distance of 487.3 feet; thence deflect right at an angle of 75°31' for a distance of 630.3 feet; thence deflect left at an angle of 76°56' for a distance of 1205.8 feet; thence deflect left at an angle of 80°54' for a distance of 975.4 feet and to the South rights of way line of Trunk Highway 14 and 56; thence deflect left at an angle of 58°51' (along said R/W line) for a distance of 2584.0 feet to the point of beginning, containing 100.63 acres and located in Sections Twenty-eight (28), Twenty-nine (29), and Thirty-three (33), Township One Hundred Seven (107) North, Range Seventeen (17) West;

That part of the Northwest Quarter (NW¼) of the Southwest Quarter (SW¼) of Section Twenty-eight (28), Township One Hundred Seven (107) North, Range Seventeen (17) West, shown as Parcel 207A on the plat designated as Minnesota Department of Transportation Right of Way Plat Numbered 20-21 on file and of record in the office of the County Recorder in and for Dodge County, Minnesota; containing 0.13 acres, more or less

That part of the West Half (W½) of the Southwest Quarter of Section Twenty-eight (28), Township One Hundred Seven (107) North, Range Seventeen (17) West of the 5th Principal Meridian, Dodge County, Minnesota, described as follows:

Commencing at the Northwest corner of said Southwest Quarter (SW¼); thence on an assumed bearing of South 0°57'41" East, along the West line of said Southwest Quarter (SW¼) a distance of 621.87 feet to a point on the southerly right-of-way line of Trunk Highway No. 14, said point being the point of beginning of the land to be described; thence South 51°18'45" East along said right of way line a distance of 569.45 feet; thence North 38°41'15" East along said right-of-way line, a distance of 10.00 feet; thence South 51°18'45" East along said right-of-way line, a distance of 179.23 feet; thence South 0°57'41" East a distance of 553.21 feet; thence South 89°02'19" west a distance of 582.82 feet to a point on the West line of said Southwest Quarter (SW¼); thence North 0°57'41" West along said West line a distance of 1023.23 feet to the point of beginning; containing 10.50 acres, more or less.

Beginning at the Northwest corner of the Northwest Quarter (NW¼) of said Section Thirty-three (33); thence S 00°06'59" West, assumed bearing, along the West line of said Northwest Quarter (NW¼), 552.45 feet; thence S 86°24'14" East, 641.28 feet; thence N 13°51'00" West, 608.35 feet to the North line of said Northwest Quarter (NW¼); thence N 89°45'57" West, along said North line, 493.28 feet to the point of beginning. Containing 7.40 acres, more or less.

That part of the Southeast Quarter (SE¼) of the Southeast Quarter (SE¼) of Section Twenty-Nine (29), Township One Hundred Seven (107) North, Range Seventeen (17) West, Dodge County, Minnesota described as follows:

Commencing at the Southeast corner of the Southeast Quarter (SE¼) of said Section Twenty-nine (29); thence N 00°12'06" W, assumed bearing, along the East line of said Southeast Quarter (SE¼), 421.42 feet for a point of beginning; thence continue N 00°12'06" W, along said East line, 450.00 feet; thence N 54°24'49" W, 103.23 feet; thence S 13°25'21" W, 284.87 feet; thence S 33°03'43" E, 278.00 feet to the point of beginning. Containing 1.09 acres, more or less.

Tract 4

That part of the North One-Half (N½) of the Northeast Quarter (NE¼) of Section Thirty-two (32),

Township One Hundred Seven (107) North, Range Seventeen (17) West, Dodge County, Minnesota described as follows:

Commencing at the Northeast corner of the Northeast Quarter (NE¼) of said Section Thirty-two (32); thence S 00°06'59" W, assumed bearing, along said East line of said Northeast Quarter (NE¼), 169.00 feet for a point of beginning; thence continue S 00°06'59" W, along said East line , 1140.07 feet to a point being 24.00 feet North of the Southeast corner of the Northeast Quarter (NE¼) of said Northeast Quarter (NE¼); thence N 89°59'23" W, parallel with the South line of the North One-Half (N½) of said Northeast Quarter (NE¼), 1281.18 feet; thence N 57°55'17 W", 98.63 feet; thence N 29°23'25" W, 121.97 feet; thence N 30°26'17" W, 273.81 feet; thence N 16°33'48" W, 168.28 feet; thence N 41°35'23" E, 176.40 feet; thence N 83°21'52" E, 131.71 feet; thence N 88°33'34" E, 522.97 feet; thence S 88°01'51" E, 403.55 feet; thence N 40°01'25" E, 109.69 feet; thence N 26°50'54" E, 172.69 feet; thence N 11°35'52" E, 87.25 feet; thence N 44°22'20" E, 99.98 feet; thence N 78°14'29" E, 207.93 feet to the point of beginning. Commencing at the Northwest corner of the Northwest Quarter (NW¼) of said Section Thirty-three (33); thence S 00°06'59" W, assumed bearing along the West line of said Northwest Quarter (NW¼), 552.45 feet; thence S 86°24'14" E, 641.28 feet for a point of beginning; thence N 89°13'37" E, 460.00 feet; thence S 00°46'23" E, 315.00 feet; thence N 81°22'25" W, 470.01 feet; thence N 00°06'59" E, 238.27 feet to the point of beginning. Containing 2.93 acres, more or less

Acreage is 98.72 acres, more or less.

Section 4. Filing. The City Clerk is directed to file certified copies of this ordinance with Minnesota Planning, the Secretary of State, the Town Clerk, and the County Auditor.

Section 5. Effective Date. This ordinance takes effect upon its passage and publication and the filings of the certified copies as directed in Section 4, and approval of the ordinance by the Minnesota Municipal Board.
